Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Trustory website and the consulting services we provide. By engaging Trustory, submitting an intake form, and/or making a payment, you agree to these Terms. If you do not agree, please do not use the services.
1. Who we are
“Trustory”, “Trustory Consulting”, “we”, “us”, or “our” refers to Trustory FZCO, registered at IFZA Business Park, Building A2, Dubai Silicon Oasis, Dubai, United Arab Emirates. You can reach us at info@trustory.ae.
2. Services
Trustory offers three paid products: Brand Audit, Brand Strategy, and Strategy + Handoff. The scope, deliverable, and turnaround of each are described on our home page and confirmed in the intake email sent after payment.
Our services are strategic advisory in nature. We produce written audits, recommendations and supporting artefacts based on the inputs you provide. The decision to adopt, modify, or implement any recommendation rests entirely with you.
3. How an engagement begins
An engagement is formed when (a) you complete the intake form and (b) your payment is received in our bank account. If the inputs are not usable, we will reply with clarifying questions before work begins.
4. Fees and payment
All prices are listed in US Dollars (USD) and are exclusive of any applicable taxes unless stated otherwise. Payment is made by direct bank transfer to the account details provided at the time of order, quoting the unique payment reference issued with your order. Fees are payable in full at the time of order, and work begins once the funds have been received in our account. Any bank charges or transfer fees are borne by the sender. We do not invoice on net terms unless agreed in writing.
5. Turnaround
The standard turnaround for each product is communicated in the intake confirmation email. Turnaround begins on the day inputs are accepted as usable. Time spent waiting on missing, incomplete, or unclear inputs from you does not count toward turnaround.
6. Your responsibilities
You represent and warrant that all information and documents provided by you (“Information and Documents”) are true, accurate, complete, current, lawful, and authorised for disclosure and use. You further confirm that you have obtained all necessary rights, approvals, consents, and authority to provide such Information and Documents in connection with our services, and that such Information and Documents do not infringe, misappropriate, or violate any intellectual property rights, confidentiality obligations, or other rights of any third party, or any applicable laws or regulations.
You remain solely responsible for the accuracy, completeness, legality, authenticity, and validity of all Information and Documents submitted by you. We are under no obligation to independently verify the accuracy, completeness, authenticity, ownership, or legality of any Information and Documents provided by you.
You acknowledge that any delay, deficiency, inaccuracy, omission, or failure in providing the required information and documents may impact the performance, timelines, quality, or delivery of the services, and we shall not be responsible for any resulting delays, losses, claims, or issues arising therefrom.
7. No outcome warranty
We provide the services on a reasonable efforts basis and make no representations, warranties, guarantees, or assurances, whether express or implied, regarding any specific outcome, result, approval, commercial success, business performance, regulatory acceptance, or other anticipated benefit arising from the services.
You acknowledge and agree that any decisions, actions, reliance, implementation, use, or outcomes based on the services, deliverables, information, recommendations, or materials provided by us are undertaken solely at your own discretion and risk.
We do not warrant or guarantee that the services will achieve your intended objectives, meet your expectations, secure approvals, prevent losses, ensure compliance, avoid third-party claims, or produce uninterrupted, error-free, or commercially successful results.
To the maximum extent permitted by applicable law, we expressly disclaim all liability for any direct, indirect, incidental, consequential, special, regulatory, reputational, commercial, or financial losses, damages, claims, or liabilities arising out of or relating to the use of, reliance upon, or inability to achieve any expected outcome from the services.
8. Use of AI
Trustory’s Identity Marketing Engine combines proprietary methodology with generative AI tools. Deliverables are AI-assisted and human-reviewed: a draft is produced with AI assistance, then reviewed, edited, regenerated using AI, and finally approved by our team members before being sent to you. The final deliverable is the product of that combined process.
We do not knowingly submit your confidential inputs to AI providers that train their public models on your data. The current list of sub-processors involved in producing deliverables is available on request.
9. Intellectual property
Upon full payment, you own the final deliverable produced for you (the PDF, the strategy document, and, where applicable, the HTML file) for use within your business. Trustory retains all rights, title, and interest in our underlying methodology, frameworks, templates, prompts, tooling, and any pre-existing materials used to produce the deliverable.
You grant Trustory the right to reference the engagement anonymously (without naming you or your brand) in portfolio, case studies, and marketing materials. If you would prefer we do not reference the engagement at all, email info@trustory.ae and we will honour that request.
10. Confidentiality
We shall maintain the confidentiality of any non-public information and documents provided by you (“Confidential Information”) and shall process any personal data in accordance with applicable laws and regulations of the United Arab Emirates and our Privacy Policy.
We shall implement reasonable administrative, technical, and organisational safeguards to protect Confidential Information against unauthorised access, disclosure, misuse, alteration, or loss. Confidential Information shall only be disclosed where necessary for the provision of the services, to authorised personnel or service providers under appropriate confidentiality obligations, or where required by applicable law or regulatory authority.
You acknowledge that electronic communications, cloud storage, and third-party systems may be used in connection with the services. While we apply commercially reasonable security measures, no method of transmission or storage is completely secure, and we do not guarantee absolute security against unauthorised access or cyber incidents beyond our reasonable control.
This clause shall be read together with and subject to our Privacy Policy.
11. Refunds and cancellation
Refunds are governed by our Refund & Cancellation Policy.
12. Limitation of liability
To the fullest extent permitted under applicable law, we shall not be liable for any direct, indirect, incidental, consequential, special, punitive, commercial, financial, regulatory, or reputational losses, damages, claims, costs, or liabilities arising out of or relating to the services, deliverables, use of the platform, delays, interruptions, third-party actions, or inability to achieve any intended result or outcome, except to the extent directly resulting from our material breach of these Terms of Service and fraudulent misrepresentation and fraud.
In all circumstances, our total aggregate liability arising out of or in connection with the services or these Terms, whether in contract, tort, negligence, strict liability, statute, or otherwise, shall not exceed the total fees actually paid by you to us for the specific services giving rise to the claim.
You acknowledge and agree that the limitations and exclusions of liability set forth herein are reasonable, form an essential basis of the agreement between the parties, and shall apply to the fullest extent permitted under the laws of the United Arab Emirates.
13. Term and termination
These Terms shall remain in full force and effect for as long as you access or use our services, platform, or deliverables, unless terminated in accordance with these Terms.
We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or terminate your access to the services, platform, or any related deliverables at any time if: (i) you breach these Terms; (ii) you provide false, misleading, unlawful, or unauthorised information or documents; (iii) your actions may expose us to legal, regulatory, security, financial, or reputational risk; or (iv) such suspension or termination is required to comply with applicable law, regulatory requirements, or governmental authority.
You may discontinue use of the services at any time; however, termination or discontinuation shall not relieve you of any payment obligations, accrued liabilities, confidentiality obligations, intellectual property restrictions, or any other provisions which by their nature are intended to survive termination.
Upon termination, we may immediately suspend or revoke access to the services, systems, accounts, data, materials, or deliverables without liability to you. We shall not be responsible for any losses, damages, interruptions, or claims arising from or related to such suspension or termination.
Any provisions relating to limitation of liability, confidentiality, intellectual property, payment obligations, dispute resolution, governing law, indemnities, and any other provisions intended to survive termination shall remain in full force and effect notwithstanding termination or expiration of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms or any engagement shall be subject to the exclusive jurisdiction of the Dubai Courts.
15. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the most recent change. The version of the Terms in effect on the date your engagement begins is the version that governs that engagement.
